- "Listing" means an advertisement for construction equipment or plant machinery posted on our Website
- "Seller" means a user who creates listings to sell equipment
- "Buyer" means a user who inquires about or purchases equipment through our platform
- "Private Seller" means an individual selling personal equipment
- "Trade Client" means a business or dealer selling multiple items of equipment
- "Content" means text, images, videos, data, and other materials posted on the Website
2. Acceptance of Terms
By creating an account, posting a listing, or using any part of our Website, you agree to:

- Our Cookie Policy
- All applicable UK laws and regulations
We reserve the right to modify these Terms at any time. Continued use of the Website after changes constitutes acceptance of the modified Terms.
3. Eligibility
To use Plant and Machine Mart, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using our services under UK law

- Private Seller: Individual users selling personal equipment
- Trade Client: Businesses, dealers, or frequent sellers with commercial inventory
4.3 Account Security
You must:
- Keep your password secure and confidential
- Not share your account with others
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account

5.1 Payment Terms
- All fees must be paid in full before listings go live
- Payments are processed securely through our payment provider
- All prices are in British Pounds Sterling (GBP) and include VAT where applicable
- We accept major credit cards, debit cards, and other payment methods as displayed at checkout
5.2 Refund Policy
- Listing fees are non-refundable once a listing is published
- If a technical error prevents your listing from being published, we will issue a full refund or credit
- Refunds for Trade Client subscriptions may be issued on a pro-rata basis at our discretion if requested within 7 days and no listings have been published
- To request a refund, contact our support team with your listing or order details
5.3 Premium Features
Additional paid features may be available, including:
- Featured listings (highlighted placement)
- Extended listing duration
- Additional photos or descriptions
- Priority placement in search results
Pricing for premium features will be clearly displayed before purchase.
6. Creating and Managing Listings
6.1 Listing Content
When creating a listing, you must:
- Provide accurate and truthful information about the equipment
- Include clear photographs showing the actual condition of the equipment
- Disclose any defects, damage, or mechanical issues
- State the correct location of the equipment
- Set a realistic and honest price
- Include accurate technical specifications (operating hours, year, model, etc.)
6.2 Prohibited Listings
You may not list:
- Stolen or illegally obtained equipment
- Equipment with falsified documentation or altered identification plates
- Items that violate UK laws or regulations
- Equipment that poses safety hazards without proper disclosure
- Counterfeit or unlicensed equipment
- Items outside the scope of construction equipment and plant machinery
- Equipment with outstanding finance agreements (unless properly disclosed)
6.3 Listing Approval
- We reserve the right to review, approve, reject, or remove any listing
- Listings that violate these Terms will be removed without refund
- We may request additional documentation or verification before approving listings
6.4 Listing Duration and Renewal
- Listings remain active for the purchased duration (typically 4 weeks)
- You may renew listings by paying the applicable fee
- Sold items should be marked as "Sold" or removed promptly
- We may automatically remove listings after expiration
7. Buying and Selling
7.1 Marketplace Role
Important: Plant and Machine Mart is a marketplace platform only. We are NOT a party to any transaction between buyers and sellers. All sales are directly between the buyer and seller. We do not take possession of equipment, handle payments between parties, or provide warranties.
7.2 Seller Responsibilities
As a seller, you must:
- Respond promptly to buyer inquiries
- Provide additional information and photos if requested
- Allow reasonable inspection of equipment before sale
- Provide legitimate ownership documentation
- Complete the sale in good faith or decline if unable to proceed
- Remove or mark listings as sold when equipment is no longer available
- Comply with all applicable regulations regarding equipment sales
7.3 Buyer Responsibilities
As a buyer, you should:
- Conduct due diligence before purchasing (inspect equipment, verify ownership, check documentation)
- Ask questions about condition, history, and specifications
- Arrange your own inspection if possible
- Verify that the seller has legitimate ownership
- Understand that equipment is sold "as is" unless otherwise agreed with the seller
- Make your own arrangements for payment and collection/delivery
7.4 Transaction Disputes
- Disputes between buyers and sellers must be resolved directly between the parties
- We are not responsible for disputes, non-delivery, misrepresentation, or fraud
- We may provide contact information or communication records to assist with dispute resolution
- Serious violations may result in account suspension or termination
- You may report fraudulent activity or Terms violations to us for investigation
8. Finance Services - Fast n Funded Partnership
We partner with Fast n Funded, an FCA-regulated finance broker, to offer equipment finance options.
8.1 Finance Referrals
- Finance applications are processed by Fast n Funded, not by Plant and Machine Mart
- We act as an introducer only and do not provide finance services
- Fast n Funded's terms and conditions apply to all finance applications
- We may receive commission for successful finance referrals
8.2 Finance Approval
- Finance is subject to status and approval by Fast n Funded's lending partners
- We make no guarantees regarding finance approval
- Your personal and business information will be shared with Fast n Funded for assessment
- Finance terms, interest rates, and conditions are determined by the lender, not by us
9. User Conduct and Prohibited Activities
You agree not to:
- Post false, misleading, or fraudulent listings
- Engage in price manipulation or bid rigging
- Harass, threaten, or abuse other users
- Use the Website for any illegal purpose
- Scrape, copy, or harvest data from the Website using automated tools
- Attempt to circumvent our fees by transacting outside the platform after initial contact
- Create multiple accounts to evade fees or restrictions
- Interfere with the proper functioning of the Website
- Upload viruses, malware, or harmful code
- Impersonate another person or entity
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of others
10. Intellectual Property Rights
10.1 Our Content
All content on the Website, including but not limited to:
- Logo, trademarks, and branding
- Website design, layout, and functionality
- Software and code
- Text, graphics, and images created by us
is owned by Plant and Machine Mart and protected by UK and international intellectual property laws.
10.2 Your Content
When you post content (listings, photos, descriptions), you:
- Retain ownership of your content
- Grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Website and in marketing materials
- Represent that you have the right to post the content and that it does not violate any third-party rights
- Accept responsibility for any claims arising from your content
11. Disclaimers and Limitation of Liability
11.1 "As Is" Basis
The Website is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including:
- Warranties of merchantability or fitness for a particular purpose
- That the Website will be uninterrupted, secure, or error-free
- That listings are accurate, complete, or reliable
- That equipment listed meets your requirements
11.2 Limitation of Liability
To the maximum extent permitted by UK law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any disputes, losses, or damages arising from transactions between users
- Our total liability for any claim shall not exceed the fees you paid to us in the 12 months prior to the claim
- We are not responsible for the condition, safety, legality, or quality of equipment listed
- We are not responsible for the accuracy of listings or user-provided information
- We are not liable for any loss of profits, data, goodwill, or other intangible losses
11.3 Indemnification
You agree to indemnify and hold harmless Plant and Machine Mart, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Website
- Your violation of these Terms
- Your violation of any rights of another party
- Your listings or transactions
- Your content posted on the Website
12. Privacy and Data Protection
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Website, you consent to the practices described in the Privacy Policy.
13. Third-Party Services and Links
- Our Website may contain links to third-party websites or services (including Fast n Funded)

- Your interactions with third parties are solely between you and them
14. Termination and Suspension
14.1 By You
You may close your account at any time by contacting us. Please note:
- Closing your account does not entitle you to a refund of listing fees
- Active listings may be removed
- Some information may be retained as required by law
14.2 By Us
We may suspend or terminate your account immediately without refund if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Post prohibited content
- Receive multiple complaints from other users
- Fail to pay fees or charges
14.3 Effect of Termination
Upon termination:
- Your access to the Website will be revoked
- All active listings will be removed
- You remain liable for any outstanding fees or obligations
- Sections of these Terms that by their nature should survive termination will continue to apply
15. Changes to the Website and Terms
We reserve the right to:
- Modify, suspend, or discontinue any part of the Website at any time
- Change our fees and pricing with notice
- Update these Terms of Service (changes effective upon posting)
- Add or remove features
Continued use after changes constitutes acceptance. We recommend reviewing these Terms periodically.
16. Governing Law and Jurisdiction

- Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales
- You agree to submit to the personal jurisdiction of these courts

If informal resolution fails, both parties agree to attempt mediation before pursuing litigation.
